While Muammar Gaddafi in his 43-year domination committed the human right violation against Libyan citizens, he also committed the specified crimes in the statute of the International Criminal Court (ICC) including: war crimes, crimes against humanity and crimes against peace. Hence, the implementation of transitional justice over Muammar Gaddafi and the main elements of his state that played an important role in contributing to human rights violation and the mentioned triple crimes, was considered by the domestic circles of Libya and the world political actors and rulers. Despite the fact that transitional justice mechanisms in post-Gaddafi Libya has been considered, it has not been a successful experience yet. By using the descriptive-analytical method and the conceptual framework of transitional justice in international law, the authors of this paper seek to answer this key question: which factors led to failure to apply the mechanisms of transitional justice in Libya? The hypothesis to answer this question is that although the ultimate goal of implementing transitional justice is "to strengthen the rule of law and institutionalize responsiveness of the authorities," but the efficient use of the mechanisms of transitional justice requires the readiness of that society, such as the political stability and security, but in Libya lack of this readiness has led to a reverse outcome on the use of mechanisms of transitional justice, and finally has increased insecurity  in this country.}, keywords = {Libya,Post-Gaddafi,Transitional Justice,Muammar Gaddafi,Dictatorship,ISIS (Daesh)}, title_fa = {علل ناکامی در کاربرد سازوکارهای عدالت انتقالی و تأثیر آن بر بی‏ سامانی سیاسی در لیبی پساقذافی}, abstract_fa = {لیبی پس از تونس و مصر، سومین کشور شمال آفریقا بود که اعتراض‏های ضدحکومتی را در سال 2011 با هدف تغییر نظام سیاسی دیکتاتوری به دموکراسی تجربه کرد. در حالی که معمر قذافی در دوران 43 سالة قدرت خود مرتکب نقض فاحش و همه‏جانبة حقوق بشر علیه شهروندان لیبی شده بود، در جنگ داخلی سال 2011 نیز مرتکب جنایت‏های تصریح­شده در اساس­نامة دیوان کیفری بین‏المللی، شامل جنایت جنگی، جنایت علیه بشریت، جنایت علیه صلح شد. از این‏رو، اجرای عدالت انتقالی دربارة معمر قذافی و عناصر اصلی حکومت وی که در نقض حقوق بشر و جنایت‏های سه‏گانه نقش داشتند، مورد توجه محافل داخلی لیبی و بازیگران نظام جهانی قرار گرفت. با وجود این­که سازوکارهای عدالت انتقالی در لیبی پساقذافی مورد توجه قرار گرفت، اما در زمینة اجرا تجربة موفقی نبوده است. نگارندگان این مقاله با بهره‏گیری از روش توصیفی- تحلیلی و چارچوب مفهومی عدالت انتقالی در حقوق بین‏الملل، درصدد پاسخ­گویی به این پرسش کلیدی هستند که چه عواملی سبب ناکامی در کاربرد سازوکارهای عدالت انتقالی در لیبی پساقذافی شده است؟ فرضیة مورد آزمون در پاسخ به این سؤال نیز این است که اگرچه هدف نهایی از اجرای عدالت انتقالی «تقویت حکومت قانون و نهادینه کردن پاسخ­گویی مقامات» است، اما به کارگیری کارامد سازوکارهای عدالت انتقالی مستلزم آمادگی آن جامعه، از جمله وجود ثبات سیاسی و امنیت است که در لیبی پساقذافی نبود؛ این عدم آمادگی سبب اثرات معکوس سازوکارهای عدالت انتقالی و افزایش ناامنی شده است.}, keywords_fa = {لیبی,پساقذافی,عدالت انتقالی,معمر قذافی,دیکتاتوری,داعش}, url = {https://piaj.sbu.ac.ir/article_99419.html}, eprint = {https://piaj.sbu.ac.ir/article_99419_0e93daaafec2edbfba97fcd557ce1f0a.pdf} }
